New transparency regulations governing the relationship between online food delivery platforms and restaurants took effect in Türkiye Wednesday. The rules specify how these platforms can charge restaurants for commissions and related services.
The measure applies to electronic commerce intermediary service providers operating in the food-ordering sector. It sets standard rules for commissions, advertising fees, courier charges, and campaign participation fees after complaints over high commission rates and shifting costs.
Under the new rules, all fees collected from restaurants must be shown in detail through a seller panel accessible only to the restaurant. Charges must be listed by service category.
At the order-approval stage, consumers will be able to see general information outlining the delivery-related costs collected from the seller and the types of expenses included.
The regulation bars platforms from charging restaurants an extra fee for core services such as creating the order, sending it to the restaurant, handling the payment process, and providing the basic infrastructure needed for the system to operate.
Moreover, platforms cannot charge restaurants simply for joining a campaign if no additional service is provided. If a platform offers an extra service as part of a campaign, it must clearly disclose the cost before participation.
The regulation also sets out rules on how commissions will be calculated in different cases.
For instance, if no discount is applied, the commission will be based on the actual product price. However, if the restaurant announces a discount, the commission will be based on the amount paid by the consumer.
In case both the platform and the restaurant announce discounts, the commission will be calculated on the amount paid by the consumer plus the part of the discount covered by the platform.
The new regulation also says that delivery platforms cannot force restaurants to join campaigns, discounts, advertising activities, or extra services and the restaurants that reject these offers cannot face penalties or restrictions. Approval for extra services depends entirely on the restaurant’s consent, which can be withdrawn at any time.
